Use of the website:

 You agree that;

• The Personal Information which you are required to provide when you register as a customer is true, accurate, current and complete in all respects.
• You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorized to use.
• A few of our items, e.g. jewelry, flowers, etc. may not have a 100% match to the displayed picture. However, we do ensure to match the style, color, stones (in jewlery), etc., so that the item is 80-90% similar to what you see.
• MyGiftShop makes no representations or warranties of any kind, stated or implied, as to the operation of the site, the details, content, materials or products, included on this site. To the full extent permissible by applicable law, MyGiftShop disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and condition for a particular purpose.  MyGiftShop will not be liable for any damages of any kind arising from the use of this site, including but not limited to direct, indirect, incidental punitive and consequential damages. No oral advice or written information given by MyGiftShop.com.pk nor its affiliates, nor any of their officers, managers, directors, employees, agents, providers, or the like, shall create a warranty; nor shall user rely on any such information or advice.
• Returns for electroic items such as Mobiles are not acceptable. Recipents will be provded warranty cards from mobile companies, e.g. Mobilezone, United Mobiles and other reputed phoe companies which can be contacted in case of a problem with the product.
• All content included on this site are protected by copyrights. User may not modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the Content, in whole or in part.

Our rights

We reserve the right to modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any amendment to or removal of the website, and / or change its user environment from time to time, and your continued use of the website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the conditions have been changed. If you do not agree to any change to the conditions, then you must immediately send us your feedback and suggestions. But we will not be bound to make any further changes upon any user’s recommendation, feedback or suggestion, etc.

Purchase of products

We will take all sensible care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Website.

Order Creation and Electronic Contracting

The technical steps required in creating a contract between you and MyGiftShop are as follows:

• You place the order for your products on the MyGiftShop website by pressing the confirm order button at the end of the check-out process. You will be guided through the process of placing an order by a series of simple instructions on the website.
• We will send to you an order acknowledgement email detailing the products you have ordered. This is not an order confirmation or order acceptance from MyGiftShop.
• As your product is shipped from our warehouse we will send you a dispatch confirmation email stating that your order is at “Processing” state.
• Order acceptance and the completion of the contract between you and us will take place on the dispatch of the Product/s to the shipping address mentioned by you.

The Non-acceptance could be of one of the following reasons;

• The product you ordered being unavailable from stock
• Our inability to obtain authorization for your payment
• Non-payment from your side, in case of an order with a payment method other than credit card.
• The identification of a pricing or product description error
• You not meeting the eligibility to order criteria set out in the main Terms & Conditions.

 Order Cancellation

Please note that you are entitled to cancel your order, provided that you must return your order no longer than eight working days after the day on which you receive the Products. Any products returned must be in their original packaging, and unused.

In most cases, orders placed to your personal specification, we are unable to refund or exchange the product. In that case all refunds or exchange will be made at the discretion of company’s management. If you wish to cancel your order prior to the order dispatch, a 10% surcharge is deducted from the total amount as an order cancellation charge and money transfer fee.

Please note that your right to return Product/s does NOT apply to Products, which fall into the following categories:

• Goods made to your specification (for example custom made dresses, mugs, suits, etc.)
• Perishable goods (Flowers, Pastries, Cakes, Mithai, etc.)

When you place an order for flowers and cakes/pastries, should you realize you have made a mistake or change your mind, we are able to amend or cancel your order within two hours of it being placed. A cancellation or amendment will not be accepted after this time.

Flowers/Cakes

In the event of supply difficulties, we reserve the right to substitute goods or packaging of equal quality and value. Complaints about the flowers and cakes and any perishable items should register within an hour of delivery. Any complaints after that will not be considered.

Payment

• All prices are correct at the time of entering the information onto the system. The total cost of your order is the price of the Products ordered plus delivery charges as set out in the Delivery section of this Website. Payment can be made by any of the methods specified in the Payment section of this Website and payment will be debited and cleared from your account as set out in the Payment section of this Website.
• You confirm that the credit, debit card that is being used is yours.
• All credit/debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorize payment to us, we will not be liable for any delay or non-delivery.
